@SoYoureALiar The rule of thumb for queries is usually to only apply to one agent at an agency at a time, otherwise your work tends to look like spam. I'd say that your only options are to be patient for the first agent to catch up to your submission (if you know for sure that she's running late) or withdraw your query. If the first agent has a clause that no response means no, and you aren't sure if she's behind, then you would probably be safe to CNR the first query and apply with Mr. Ellor.

Question -- I submitted to an agent at JD Lit a while ago, and it appears this agent is super behind on reading queries and I have no idea when (or even if) she will get to mine. I'd really like to submit to Mr. Ellor, but I don't want to withdraw from that first agent. I can't find anywhere on JD's site if simultaneous submissions are allowed. Advice?

“Thank you for sending me the manuscript for THE WAY OF THE HUNTRESS. I'm sorry to say, though, that the material does not seem to be a fit for my list at this time, and so I must pass. It’s strong writing and I think it will really grab another agent!

Thank you for the opportunity, and good luck with other agents.”

Is this a personalized form? At least he was fast. Fingers crossed for the other agents :(
